Terms and Conditions

3.1 Account Creation

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You must be at least 18 years old to create an account
• One person or legal entity may not maintain more than one free account
• You must provide a valid email address for account verification and communications

3.2 Account Security

• You are responsible for all activities that occur under your account
• You must notify us immediately at learn@lerenlabs.com of any unauthorized access or security breach
• We reserve the right to suspend or terminate accounts that violate these Terms
• You must not share your account credentials with others

4.1 Subscription Tiers

• All fees are stated in Euros (€) and exclude applicable taxes
• Subscription fees are billed monthly in advance
• Payment is processed through our secure payment provider
• All fees are non-refundable except as required by law or as explicitly stated in these Terms
• You authorize us to charge your designated payment method for all applicable fees

4.3 Subscription Management

• Subscriptions automatically renew at the end of each billing period unless canceled
• You may upgrade your subscription at any time, with changes taking effect immediately
• You may downgrade your subscription, with changes taking effect at the start of the next billing period
• You may cancel your subscription at any time through your account settings
• Upon cancellation, you retain access until the end of your current billing period
• We reserve the right to change subscription fees with 30 days' advance notice

4.4 Free Trial (if applicable)

• Free trials, if offered, are limited to new users who have not previously subscribed
• Credit card information may be required for trial activation
• Unless canceled before trial expiration, you will be automatically charged for the selected plan
• We reserve the right to modify or cancel free trial offers at any time

4.5 Taxes

You are responsible for all applicable taxes, duties, and governmental charges associated with your use of the Service, excluding taxes based on our net income.

5.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms.

5.2 Prohibited Activities

You agree NOT to:

• Violate any applicable laws or regulations
• Upload data that you do not have the legal right to process
• Upload data containing personal information without proper legal basis (GDPR compliance required for EU data)
• Infringe upon intellectual property rights of others
• Upload or transmit viruses, malware, or malicious code
• Attempt to gain unauthorized access to our systems, networks, or other users' accounts
• Use the Service to transmit spam or unsolicited communications
• Reverse engineer, decompile, or disassemble any part of the Service or AI models
• Resell, redistribute, or sublicense the Service without written authorization
• Use automated systems (bots, scrapers) to access the Service beyond normal usage patterns
• Exceed usage limits for your subscription tier
• Share your account credentials or allow unauthorized access
• Use the Service in any way that could damage, disable, or impair our infrastructure
• Attempt to circumvent usage limitations or access controls
• Upload data containing illegal content, hate speech, or content that violates third-party rights
• Use the Service to create competing products or services

6.1 Your Data

• You retain all ownership rights to the data you upload to the Service
• You are solely responsible for the accuracy, legality, and appropriateness of your data
• You represent and warrant that you have all necessary rights and permissions to upload and process your data through the Service
• You must ensure compliance with all applicable data protection laws (including GDPR, if applicable)

6.2 License to Process Your Data

• You grant us a limited, non-exclusive, worldwide license to access, process, analyze, and store your data solely for the purpose of providing the Service
• Our AI agents will process your data to perform analysis, generate visualizations, detect anomalies, and provide insights
• We may use anonymized and aggregated data to improve our AI models and Service functionality

6.3 Data Security and Storage

• We implement industry-standard security measures to protect your data
• Your data is processed using encryption in transit and at rest
• However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security
• You acknowledge and accept the inherent risks of internet-based data processing
• We are not responsible for unauthorized access resulting from your failure to secure your account credentials

6.4 Data Retention and Deletion

• We retain your data for as long as your account is active and as necessary to provide the Service
• Upon account termination, we will delete your data within 90 days, except where retention is required by law
• You may request data deletion at any time by contacting learn@lerenlabs.com
• Backup copies may persist for up to 30 additional days

6.5 Data Processing Locations

Your data may be processed and stored in servers located in the European Union and other jurisdictions where we or our service providers maintain facilities.

6.6 Third-Party Data Sources

When you connect external data sources (Google Sheets, Airtable, Postgres, MySQL), you authorize us to access and process data from these sources on your behalf. You are responsible for maintaining necessary permissions and access rights.

7.1 Nature of AI Analysis

• The Service uses artificial intelligence and machine learning to generate data analysis, insights, and recommendations
• AI-generated results are probabilistic and may contain errors, inaccuracies, or biases
• You are solely responsible for verifying the accuracy and appropriateness of AI-generated outputs before making decisions based on them

7.2 No Professional Advice

• The Service provides automated data analysis tools and does not constitute professional advice (financial, medical, legal, or otherwise)
• You should not rely solely on AI-generated insights for critical business, financial, or medical decisions
• We recommend consulting qualified professionals for important decisions

7.3 Limitations of AI

• AI models have inherent limitations and may not detect all anomalies or patterns in your data
• Results may vary based on data quality, format, and complexity
• We do not guarantee specific outcomes or accuracy levels

8.1 Our Rights

• The Service, including all software, algorithms, AI models, features, functionality, user interface, and documentation, is owned by Leren Leren and protected by intellectual property laws
• Our trademarks, logos, and service marks (including "ETL0") are our exclusive property
• You may not use our intellectual property without express written permission

8.2 User Content

• You retain ownership of your uploaded data and any content you create using the Service
• Visualizations, reports, and exports generated from your data belong to you
• You grant us a license to display your content within the Service as necessary to provide the Service features

8.3 Analytics and Service Improvement

• We use analytics tools to collect usage data to improve user experience and Service functionality
• This includes information about how you interact with the Service, feature usage patterns, and performance metrics
• You may opt out of analytics tracking through your account settings
• We do not use your uploaded data or AI-generated outputs to train AI models
• We use third-party AI services (such as OpenAI's GPT models) to provide Service functionality; these services process your data according to their respective terms and privacy policies

8.4 Feedback

Any feedback, suggestions, or ideas you provide about the Service become our property, and we may use them without compensation or attribution.

9.1 Uptime and Availability

• We strive to maintain 99% uptime but do not guarantee uninterrupted or error-free service
• We may perform scheduled maintenance with advance notice when possible
• Emergency maintenance may occur without notice
• Service interruptions may occur due to factors beyond our control

9.2 Service Modifications

• We reserve the right to modify, suspend, enhance, or discontinue any feature of the Service at any time
• We will provide reasonable notice of material changes that negatively affect your subscription tier
• Subscription features are subject to change; we will maintain substantially similar functionality within each tier

9.3 Usage Limits

• Usage limits (file uploads, simultaneous analyses) are enforced based on your subscription tier
• Excessive usage that impacts service performance may result in throttling or temporary suspension
• Enterprise tier "unlimited" usage is subject to fair use policies

10.1 Termination by You

• You may cancel your subscription at any time through your account settings
• You may request account deletion by contacting learn@lerenlabs.com
• Cancellation takes effect at the end of your current billing period
• No refunds are provided for partial billing periods

10.2 Termination by Us

We may suspend or terminate your account immediately if you:

• Violate these Terms or our Acceptable Use Policy
• Engage in fraudulent activity or payment disputes
• Fail to pay applicable fees within 10 days of the due date
• Pose a security risk to the Service or other users
• Upload illegal or harmful content
• Exceed usage limits or engage in abusive behavior

10.3 Effect of Termination

• Upon termination, your right to use the Service ceases immediately
• You lose access to your account, data, and all Service features
• We may delete your data in accordance with Section 6.4
• Outstanding fees remain due and payable
• Provisions that by their nature should survive termination will remain in effect

11.1 Privacy Policy

Our collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated by reference into these Terms.

11.2 GDPR Compliance

• For users in the European Union, we process personal data in compliance with the General Data Protection Regulation (GDPR)
• We act as a data processor for data you upload to the Service
• You are the data controller and are responsible for ensuring lawful processing of personal data
• You must have appropriate legal bases (consent, legitimate interest, etc.) for processing personal data through our Service

12.1 "AS IS" Basis

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR QUIET ENJOYMENT.

12.2 No Guarantees

WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, secure, or error-free
• AI-generated analysis will be accurate, complete, or reliable
• Defects will be corrected
• The Service is free from viruses or harmful components
• Results will meet your requirements or expectations

12.3 Your Risk

You use the Service at your own risk. You are solely responsible for any damage to your systems or loss of data resulting from your use of the Service.

13.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LEREN LEREN SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Business interruption or loss of goodwill
• Errors or inaccuracies in AI-generated analysis or outputs
• Decisions made based on Service outputs
• Damages arising from unauthorized access to your data

13.2 Liability Cap

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR €100, WHICHEVER IS GREATER.

13.3 Essential Purpose

These limitations apply even if a remedy fails of its essential purpose.

13.4 Jurisdictional Variations

Some jurisdictions do not allow certain liability exclusions or limitations, so the above may not apply fully to you. In such cases, our liability is limited to the maximum extent permitted by law.

15.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Portugal, without regard to conflict of law principles.

15.2 Jurisdiction

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Aveiro, Portugal.

15.3 Informal Resolution

Before initiating formal proceedings, you agree to contact us at learn@lerenlabs.com to attempt to resolve the dispute informally for at least 30 days.

15.4 EU Online Dispute Resolution

EU consumers may use the Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

16.1 Entire Agreement

These Terms, together with our Privacy Policy and any other referenced policies, constitute the entire agreement between you and Leren Leren regarding the Service and supersede all prior agreements.

16.2 Severability

If any provision of these Terms is found unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative.

16.4 Assignment

• You may not assign or transfer these Terms or your account without our prior written consent
• We may assign our rights and obligations without restriction
• Any attempted unauthorized assignment is void

16.5 Force Majeure

We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including natural disasters, war, terrorism, riots, labor disputes, internet failures, or governmental actions.

16.6 Export Compliance

You agree to comply with all applicable export and import laws and regulations. You represent that you are not located in a country subject to embargo or listed as a prohibited party.

16.7 Independent Contractors

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Leren Leren.

16.8 Language

These Terms may be translated into other languages for convenience. In case of conflict, the English version prevails.

• Your continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms
• If you do not agree to the changes, you must stop using the Service and may cancel your subscription
